The Second Amendment Protection Act is now law in the state of Kansas. The measure, signed by Governor Sam Brownback this week, appears to be a preemptive strike against against any new gun control regulations from Washington.

The new law that protects gun rights in Kansas stipulates that Any act, law, treaty, order, rule or regulation of the government of the United States which violates the Second Amendment to the Constitution of the United States is null, void and unenforceable in the state of Kansas.

The law would also rules out any federal attempts to ban magazines, ammunition, or certain weapons within the borders of Kansas.

According to one of the laws proponents, The new Kansas law stands as the strongest and most sweeping defense of the right to keep and bear arms in the entire country so far.

In general, it would be very difficult for the feds to enforce any new gun control measures without the cooperation of state and local law enforcement in a particular state or states.

In passing the Second Amendment Protection, Kansas is reasserting its rights under the 10th Amendment in the relationship between the federal and state government as well. That amendment reads the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States, respectively, or to the people. The founders in general felt that the central government should be limited by the enumerated (i.e., listed) powers described in the Constitution rather than being all-powerful and that the states individually should run most things within their borders.

One of the state lawmakers who sponsored the bill indicated that the Second Amendment Protection Act also has an economic component. It creates a stark contrast with our neighbors in Colorado. I consider it a pro-job growth bill becauseof it encouraging the large gun manufacturers or those who make gun components to move to Kansas.

Gov. Brownback, who took office in 2011 (and prior to that served as US Senator) also signed a law that allows public schools and colleges to have designated employees carry concealed weapons and loosened restrictions in the future for carrying guns in public buildings.

‘Second Amendment Protection Act’ Signed Into Law By Kansas Gov. Brownback

A Sedgwick County commissioner wants to see the commission speak in a unified voice in support of the Second Amendment.

Richard Ranzau has placed a resolution on the commissions agenda for Wednesday calling for that support. The resolution also may be discussed Tuesday during the commissioners meeting with county staff.

I think its important that elected officials stand up for the rights of their constituents, Ranzau said. The more voices we have speaking in unison, it may send a message to the federal government.

After all, he said, People on the other side are banding together.

The resolution, which is not binding, calls for the preservation of an individuals right to keep and bear arms.

It calls on the county not to enforce any international, federal, state or local statute, ordinance, resolution, executive order, regulation, proclamation or treaty that conflicts with the Second Amendment and the Kansas Bill of Rights. The resolution also calls for Congress, the Kansas governor and Legislature and all elected state officials to take similar action in upholding the Second Amendment.

Ranzau said the resolution is based on what Seward County, in southwest Kansas, adopted in February.

Actually, it comes from a boilerplate resolution being used recently by a number of cities and counties across the country. The language is almost identical in the resolutions.

Syracuse, in western Kansas, adopted the resolution in March, claiming to be the first city in the state to do so.

Ranzau said his resolution is primarily to address the issue and concerns that were having at the federal and international levels.

On March 11, Syracuse became the first municipality in Kansas to adopt a resolution supporting the Second Amendment. At that time, Syracuse Mayor Joe Hopkins said he hoped other that communities would follow suit. So far, at least two other southwest Kansas communities have either passed, or are getting ready to pass, similar resolutions.

Becky Malewitz/Telegram Mirroring a resolution recently passed in Syracuse, Lakin is looking into passed a resolution vowing to uphold the Second Amendment.

On Wednesday, the Ulysses City Commission and Grant County Commission adopted a resolution aimed to preserve and defend the Second Amendment.

“It was done at the request of several citizens in town who had concerns about what might be going on with the Second Amendment,” Alan Olson, interim city administrator said.

When asked if the resolution will provide any real power to the city or county, should the Second Amendment ever be revised or amended, Olson declined to comment.

Lakin is the next southwest Kansas community set to pass a resolution of this nature at the Lakin City Commission meeting on Monday. It was first discussed at the April 1 meeting.

Second Amendment resolutions gain ground locally

Columnist Steve Gunn cited examples of attacks on our First Amendment rights that he believes are spreading across the country in his column, “Our First Amendment rights are threatened every day.”

Gunn wrote:

Every so often I come across frightening examples of how our First Amendment rights — which are obviously the most important key to our continued freedom — can be threatened or lost in a tragic heartbeat.

I found two over the past week that either made my blood boil with anger or took my breath away with fright.

The first came via a news story from Kansas, where the state legislature is considering a law that would limit collective bargaining privileges for public sector labor unions. Obviously there is a lot of interest in this legislation, particularly from the unions.

But heres the really creepy part. Kleeb later explained that he was adhering to a traditional policy that allows credentialed members of the media to videotape committee meetings, but not other citizens.

Why would there be such a policy? Because, according to Kleeb, the media is held to a higher standard when it comes to editing and production.

First of all, any open government meeting should be open to everyone to attend or record as they please. Reporters are not licensed (thank you God) and should not have any special access to government that other citizens dont have.

Every citizen is a news reporter if he or she chooses to be. We can all attend meetings and report what we see and hear, the same as anyone who writes for the local newspaper or reports for the local television station.

The 7th Cavalry Regiment is a United States Army Cavalry Regiment, whose lineage traces back to the mid-19th century. Its official nickname is “Garryowen,” in honor of the Irish air Garryowen that was adopted as its march tune. Following its activation the Seventh Cavalry Regiment patrolled the Western plains for raiding native Americans and to protect the westward movement of pioneers. From 1866 to 1881, the regiment marched a total of 181692 miles (292342 km) across Kansas, Montana, and the Dakota Territories. The regiment was constituted on July 28, 1866 in the regular army as the 7th Cavalry. It was organized on September 21, 1866 at Fort Riley, Kansas as part of an expansion of the regular army following the demobilization of the wartime volunteer and draft forces. From 1866 through 1871, the regiment was posted to Fort Riley and fought in the American Indian Wars. The latest media bias controversy has put sportscaster Bob Costas in the spotlight over a brief piece of commentary last night in which he used the murder-suicide case involving Kansas City Chiefs linebacker Jovan Belcher to suggest gun control needs to be revisited. Costas came under some serious fire from conservatives, but on Bill O'Reilly's show tonight, Bernard Goldberg stood up for his friend and said Costas has nothing against guns nor the Second Amendment. NBC’s Bob Costas, through a spokesman, Monday adds to his on-air comments about gun violence.

NBC’s Bob Costas, communicating through a spokesman Monday about on-air comments about guns he made Sunday night, “feels an unfortunate leap was taken that he was advocating taking away Second Amendment rights. He was not.”

Costas declined comment to an interview request from USA TODAY Sports to speak about comments he made during NBC’s NFL coverage Sunday night. But NBC spokesman Greg Hughes says,”In a short (on-air) time period he can cover only one aspect of a complicated issue. So he quoted (columnist Jason Whitlock) about the gun culture and an almost Wild West attitude in parts of this country. He is pro-sensible gun reform and pro-attitude adjustment on guns.”

In his 90-second on-air comments Sunday that have drawn criticism in cyberspace, Costas discussed Kansas City Chief linebacker Jovan Belcher shooting girlfriend Kasandra Perkins and then committing suicide with a gun. Costas’ conclusion: “If Jovan Belcher didn’t possess a gun, he and Kasandra Perkins would both be alive today.”

Monday, NBC spokesman Hughes added that Costas is “in favor of people owning guns to hunt and carrying them in reasonably controlled circumstances.”
